Terms and Conditions

These draft terms describe the MelonPixels website service scopes for Philippine professional-service businesses. They are for counsel review, not legal advice, and are not yet effective.

Current site behavior: MelonPixels does not collect payment, schedule appointments, or run a post-checkout onboarding flow on this site. Project discussions start through the contact form; legacy links redirect there and retired APIs do not create records.

1. Status and contracting party

These are proposed website terms, not a final service agreement or a guarantee that an order will be accepted. A binding engagement should identify the correct legal entity, address, authorized signatory, order form, and effective date. Until those details are confirmed, the site is a marketing and enquiry surface; it has no online checkout or appointment scheduler and creates no binding engagement from a form submission alone.

The working operator name is MelonPixels. Contact: jeromeley@melonpixels.com. The current service location is Nuvali, Laguna, Philippines; no street address is published in this draft. The legal entity or registration name, principal address, and any appointed data protection officer or privacy contact remain to be confirmed by the operator and Philippine counsel. Questions about a specific order should be directed to that email before work or payment begins.

2. Site use and formation

Visitors may use the site for lawful business research and to submit accurate enquiries. Do not probe, scrape, interfere with, impersonate another person, upload malicious material, or send data you are not authorized to share. We may decline, pause, or remove an enquiry that creates security, legal, or operational risk.

A service contract is formed only through the counsel-approved order or written acceptance that the final terms identify. An enquiry, legacy redirect, price shown on a draft page, or demo record is not an acceptance. Any electronic records, signatures, clickwrap, and language/version precedence must be confirmed for the effective terms.

3. Website scope and options

MelonPixels offers strategy-led marketing websites. The current commercial source of truth lists two starting scopes; final pricing, timing, and care terms are confirmed after the contact conversation:

  • Single Page: ₱6,499 per month standard, or ₱3,899 per month promotional pricing for the first six months when that promotion is shown and accepted; one conversion-focused page, no blog, a three-month minimum, four revision rounds, and one strategic update request per month after launch.
  • Multi-Page: ₱12,999 per month standard, or ₱7,799 per month promotional pricing for the first six months when that promotion is shown and accepted; up to eight core pages plus a blog, a three-month minimum, four revision rounds, and one strategic update request per month after launch.

Both scopes include strategy-led copy drafting, custom design/build, SEO and GEO foundations, hosting, maintenance, support, and an inquiry form. A portal, dashboard, SaaS feature, booking marketplace, custom web app, major replatform, advanced integration, or new page beyond the selected scope is not included unless separately scoped and priced in writing.

4. Quotes, approvals, and payment terms

The website does not collect payment or create a checkout session. A written quote or order will state the agreed scope, price, payment schedule, taxes, and start conditions before production begins. A whole-site milestone draft is a complete review submission, not a single micro revision or copy tweak.

Prices shown on public pages are starting points, not a charge or acceptance. Never treat a legacy redirect, inquiry, or preview record as proof that a payment, subscription, or service start occurred.

Prices are displayed in Philippine pesos. The final order must state whether VAT or other taxes are included, how official invoices and withholding are handled, and any payment method or timing. Those details are intentionally confirmed in the written order; the operator and counsel/accountant must confirm them.

5. Production process, timing, and revisions

  • After a verified engagement and complete onboarding materials, the offer targets a first whole-site milestone draft within seven days.
  • The client reviews the whole-site milestone and may use four revision rounds under the selected plan.
  • After launch, one strategic update request per month is included. Additional rounds, new pages, or material scope changes require written approval and a separate quote.
  • Launch follows client approval or the third whole-site draft, whichever occurs first, subject to the final agreement and any outstanding client dependencies.

The seven-day statement is a stated offer target, not a promise that overrides missing materials, delayed feedback, third-party outages, legal review, or a written change order. The final agreement should define business days versus calendar days, feedback windows, deemed approval, pause/resume rules, and how a draft is delivered and recorded.

6. Client duties and acceptable content

The client must provide timely, accurate materials; identify an authorized approver; give usable brand assets, copy, offers, legal notices, domain/hosting access, and scheduling details; maintain access credentials through an approved secure channel; and review drafts promptly. The client is responsible for the truthfulness, legality, accessibility, permissions, and regulatory disclosures of its claims, prices, testimonials, images, fonts, code, and other supplied materials.

The client must not request unlawful, infringing, deceptive, discriminatory, unsafe, or privacy-invasive content. MelonPixels may pause work pending clarification or refuse content that would create legal, security, or ethical risk. A delay caused by missing materials, approvals, credentials, or client changes may move the schedule and does not by itself create a refund right; the final remedy and pause rules require counsel confirmation.

7. Intellectual property and third-party materials

The client keeps ownership of materials it supplied and grants MelonPixels the limited permission needed to use them for the engagement. The client should obtain permissions for its names, logos, claims, photographs, testimonials, fonts, and other third-party assets and should provide evidence when reasonably requested.

Proposed allocation for counsel to finalize: after all amounts due for a deliverable are paid, the client receives the agreed ownership or licence to the approved client-specific content and final website output; MelonPixels retains its pre-existing tools, templates, methods, reusable components, know-how, and third-party/open-source materials, subject to their licences. The final agreement must state whether source code, hosting configuration, domains, accounts, design files, and future updates are assigned or licensed, and whether MelonPixels may display the work in a portfolio. No transfer is promised by this draft.

8. Boundaries, availability, and no guarantees

The service is a marketing website subscription, not legal, tax, accessibility, cybersecurity, medical, financial, or search-ranking advice. SEO and GEO foundations, a scheduling system, hosting, and maintenance are included as described, but no ranking position, traffic, lead volume, conversion rate, revenue, uptime, third-party availability, or launch date is guaranteed. Any performance target, service level, support hours, backup promise, accessibility conformance level, and hosting provider must be written into the final order if offered.

9. Suspension, cancellation, and termination

Each plan has a three-month minimum commitment. The final agreement must state the notice method and period for cancellation after that minimum, what happens to a promotion, outstanding invoices, work in progress, domains, hosting, source files, client data, and handover support. It must also state whether either party may terminate for material breach, insolvency, unlawful use, security risk, or prolonged force majeure, including any cure period.

MelonPixels may temporarily suspend access or work for non-payment, missing cooperation, security threats, or unlawful content, subject to the final agreement and mandatory law. Suspension or termination does not erase amounts already due. No additional termination fee, notice period, or handover promise is created by this draft.

10. Warranties, liability, and client claims

The final agreement should describe any express service standard and disclaimed implied warranties without removing rights that cannot lawfully be excluded. It should allocate responsibility for client content, third-party services, domain ownership, security incidents caused by client credentials, and any requested indemnity. A liability cap, excluded damages, remedy window, and exceptions for fraud, wilful misconduct, confidentiality, privacy, or unpaid fees are not set here; counsel must draft them for the actual entity and customer type.

11. Governing law and disputes

The proposed commercial relationship is expected to be connected with the Philippines, but the governing law, venue, escalation contact, mediation/arbitration option, language, and service-of-process details must be confirmed by Philippine counsel. A final clause must preserve any mandatory consumer, electronic-commerce, tax, privacy, or other statutory rights; this draft does not select a court, waive a right, or require arbitration.

12. Changes, notices, and contact

The effective version will show its effective date and identify how material changes are communicated. A change to price, plan scope, billing timing, refund treatment, data processing, or liability should not be applied to an existing client without the process stated in the final agreement. 13. Open decisions before publication

  • Insert the contracting legal entity, registration details, principal address, authorized signatory, and notice method.
  • Confirm checkout, recurring billing, payment-failure, invoice, tax/VAT, withholding, currency, and promotion mechanics.
  • Approve scope, acceptance/deemed approval, feedback windows, change orders, support levels, hosting/SLA, and handover language.
  • Set intellectual-property ownership/licence, third-party asset, portfolio, confidentiality, indemnity, warranty, and liability clauses.
  • Set cancellation, termination, suspension, dispute, governing-law, venue, and mandatory-consumer-rights language.
  • Align the final terms with the Privacy Policy, Cookie Policy, and Refund Policy.
